1 Acceptance of terms
These Terms & Conditions (“Terms”) form a binding agreement between you and Surefit Gym (“Surefit”, “we”, “us”). By registering for membership, using the member portal, enrolling in biometric access, buying from our online store, or entering our premises, you confirm that you have read, understood and agree to these Terms and our Privacy Policy. If you do not agree, please do not use our services.
2 Definitions
- Member
- A person with a registered Surefit account, whether or not a subscription is active.
- Subscription
- A recurring or fixed-term membership plan that grants access to facilities and services.
- Portal
- The online platform where you manage your data, subscriptions and attendance records.
- Biometric access
- The fingerprint-based system used to verify active members at entry points.
- Store
- The Surefit online shop selling gym wear and related products.
- Premises
- Any Surefit facility or location.
3 Eligibility & membership
To become a member you must be at least [insert minimum age] years old, or have verifiable parental/guardian consent where minors are permitted, and provide accurate registration information. Membership is personal to you and may not be shared, transferred or lent. We may decline or revoke membership at our reasonable discretion, including for breach of these Terms or our gym rules.
4 Your account
You are responsible for keeping your portal login credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use. You agree to keep your account, contact and payment details accurate and up to date. We are not liable for loss arising from your failure to safeguard your credentials.
5 Subscriptions & payment
- Prices, plan features and billing cycles are shown at sign-up and may change with notice as set out below;
- By starting a subscription you authorise us (and our payment provider) to charge the applicable fees on each billing date until cancelled;
- You are responsible for any taxes and for ensuring your payment method remains valid;
- If a payment fails, we may retry, suspend access, or treat the subscription as overdue in line with [insert dunning / grace-period policy];
- Access to facilities requires an active, paid subscription.
All payments are processed by regulated third-party providers. We do not store full card details — see our Privacy Policy.
6 Renewals, cancellation & refunds

7 Biometric access
Entry to the gym is granted by scanning your fingerprint to confirm an active subscription. Biometric enrolment is voluntary and based on your explicit consent; how we handle this sensitive data is set out in our Privacy Policy.
- You must not attempt to gain access for, or on behalf of, anyone else;
- Access may be denied if your subscription is inactive, suspended or overdue;
- The system may occasionally be unavailable for maintenance or technical reasons; alternative access is [describe alternative];

8 Gym rules & conduct
While on the premises you agree to:
- Follow all posted rules, signage and reasonable instructions from staff;
- Use equipment correctly and only for its intended purpose;
- Wipe down equipment, return weights and respect shared spaces;
- Behave respectfully toward staff and other members — harassment, threatening or abusive behaviour is not tolerated;
- Not bring prohibited items, or attend under the influence of alcohol or unlawful substances;
- Not record or photograph others without consent.
We may refuse entry, suspend or terminate membership for breach of these rules, without refund where permitted by law.
9 Health, fitness & assumption of risk
Physical exercise carries inherent risks, including injury. You confirm that you are medically fit to exercise, that you participate voluntarily and at your own risk, and that you have been advised to consult a physician before beginning any exercise programme.
You are responsible for exercising within your own limits and for using equipment safely. Surefit does not provide medical advice. To the fullest extent permitted by law, you assume the risks associated with use of the facilities, classes and equipment. 10 Online store
- Product descriptions, pricing and availability may change and are subject to error correction; an order is accepted only when we confirm it;

11 Intellectual property
All content, branding, logos, designs, text, software and materials on our website, portal and store are owned by or licensed to Surefit and protected by intellectual property laws. You may use them only as needed to use our services. You may not copy, reproduce, distribute, modify or create derivative works without our prior written permission.
12 Prohibited use
You agree not to:
- Use the services unlawfully or in breach of these Terms;
- Share access credentials or allow others to use your membership;
- Attempt to bypass, probe or disrupt the portal, store or access systems;
- Upload malicious code or attempt to gain unauthorised access to our systems or data;
- Scrape, harvest or misuse data of Surefit or other members;
- Use the services to harass, defraud or harm others.
13 Suspension & termination
We may suspend or terminate your membership, portal access or store access, with or without notice, if you breach these Terms, fail to pay, pose a risk to others, or where required by law. You may end your membership in line with Section 6. On termination, your right to use the services ceases, though clauses that by their nature should survive (including liability, IP and governing law) will continue to apply.
14 Disclaimers
Except as expressly stated and to the fullest extent permitted by law, our services, facilities, portal and store are provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the services will be uninterrupted, error-free or completely secure, or that results from training will meet your expectations. This does not affect rights that cannot be excluded under applicable law.
15 Limitation of liability
To the fullest extent permitted by law, Surefit, its owners, staff and partners shall not be liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, data, goodwill, or personal property (including items left on the premises or in lockers).
Where liability cannot be excluded, our total aggregate liability arising out of or in connection with the services is limited to [insert cap — e.g. the fees you paid in the preceding [X] months]. Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot lawfully be limited.
16 Indemnification
You agree to indemnify and hold harmless Surefit and its staff and partners from claims, damages, losses and reasonable costs arising from your breach of these Terms, your misuse of the services, or your violation of any law or third-party right, to the extent permitted by applicable law.
17 Third-party services
Our services rely on third parties such as payment processors, hosting and delivery providers. We are not responsible for the acts, omissions or content of third parties, and your use of their services may be subject to their own terms. We are not liable for outages or failures caused by third-party providers beyond our reasonable control.
18 Force majeure
We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including power or network failures, equipment faults, strikes, civil disruption, government action, epidemics, fire, flood or other acts of nature.
19 Changes to these terms
We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, for material changes, give reasonable notice through the portal or by email. Your continued use of the services after changes take effect means you accept the updated Terms.
20 Governing law & dispute resolution
These Terms are governed by the laws of the [Federal Republic of Nigeria — confirm jurisdiction]. The parties will first try to resolve any dispute amicably.
